No mediated solution for CN, grain companies

Mediation between six grain shippers and CN in the level-of-service dispute between the companies and railroad ended without a resolution, the lead shipper said Friday.

The Canadian Wheat Board (CWB) said in a bulletin that the Canadian Transportation Agency will have to determine the outcome of the shippers’ complaint against CN. The shippers had filed a level-of-service complaint with the CTA in early September but indicated at the time that they were willing to seek a mediated solution, rather than enter the CTA’s quasi-judicial complaint process. CN agreed to mediated talks.

The CTA will also be asked to rule on the shippers’ request for an interim order to suspend CN’s contentious advance-products program.

Five companies — Paterson Grain, Parrish & Heimbecker, Providence Grain Group, North East Terminal and North West Terminal — and the CWB claim CN has failed to comply with the spirit of a previous CTA ruling against it. That ruling found in favour of an inland grain terminal company in Alberta.
